2022 Conditions & Regulations of Membership

Membership

  1. Membership in the Padonia Park Club (hereinafter referred to as “Padonia” or “the Club”) becomes valid and effective only after a signed & completed application is approved by management, together with proof of residency for persons 18 & over, proof of age if under 3 years of age or 62 & over as of April 30, payment in full is made and a current high resolution digital picture of each person listed on the membership are submitted online or to the Club Office.
  2. Pool use is permitted only when a Padonia Lifeguard is on duty.
  3. All PADONIA offerings, hours and services are subject to change without notice, cancelation, and limited or no availability due to renovations, refurbishment, capacity, attendance, seasonal operation, inclement weather, act of God, government restrictions, special events, safety, or any other reason at management’s sole discretion without liability to the companies, subsidiaries, affiliates or owners of PADONIA. Membership may be canceled or denied for any reason. No Refunds will be given.
  4. All Members and their guests agree to abide by these Rules and Regulations as well as any additional rules, policies, or updates to rules and policies that are posted by Padonia including but not limited to those listed on PADONIA.com and JoinPADONIA.com, and enforced by the Management and its staff from time to time. Members and guests understand and agree to accept any penalties for infractions of these Rules and Regulations, including termination or suspension of Membership or access to the Club. All Members, Parents, and Authorized Adults (as defined herein) are responsible for the safety & rule enforcement of themselves, their family members, and guests. Penalties for unsafe conduct, destruction of property, littering, unpaid or unregistered guests, and flagrant dis-regard or abuse of any of these Rules and Regulations will be imposed by Management in its sole discretion.

 

Guests

  1. All guests must be identified, pre-registered, paid for, and accompanied by the hosting member at all times. Members are responsible for making their guests aware of all Rules & Regulations. Non-members may not be a guest more than 5 times per season, regardless of the hosting Member. If the Main Entrance is closed, the hosting Member and/or guests must register and pay at the Padonia Office. No refunds will be given for any reason. Members may request to have guests, however guests may be restricted for any reason including capacity, etc.
  2. Members desiring to hold an event for 10+ guests at one time must obtain written authorization from Padonia Management at least 2 weeks prior to the event, prepay any applicable fee and submit a completed “Guest List Form“ along with any other required forms as determined by Management in its discretion. Groups of 36 or more must secure a contract including catering with Special Events & Catering with Padonia. Multiple groups acting as one will be counted and treated as one group. Padonia Management has final say on definition of “one group.” Other restrictions apply. Contact PADONIA Special Events & Catering for details.
  3. If any Member wants to reserve a designated location or grill, reservations are on a first-come, first served basis, and must be registered and approved not less than 2 weeks in advance of the requested date, together with payment of the applicable non-refundable site fee.

 

Safety

  1. For safety purposes, the following is prohibited at all times: rowdiness, roughhousing, dives other than off diving boards, running, ball throwing (other than air inflated balls), water balloons, recreational devices with wheels, mermaid tails. Water guns are not allowed in common areas, including pools.
  2. Radios & similar devices must be kept at low volume or used with earphones. Commercial and/or inappropriate photography or videography, including audio recording, is strictly prohibited.
  3. The log roller has a 175 lb./person weight limit. No more than 2 people may be on the log roller at any time, and it can only be used in specifically designated areas.
  4. Appropriate swim attire is required at all times, as determined in the sole discretion of Management (i.e. No thongs, street clothes, no visible undergarments). Wet attire is not allowed indoors. Shoes are required in all indoor facilities.
  5. All swimmers must shower directly prior to entering pools.
  6. Pursuant to applicable health department code regulations, no food of any kind may be brought onto any of the pool decks.
  7. The following is not permitted in common or pool areas: diaper changing, persons with active, or indications of, infectious or contagious illnesses or lesions; and any person eliminating any bodily wastes.
  8. Prohibited items include but are not limited to: pets, glass, firearms, ammunition, knives and weapons of any kind. Objects or toys that appear to be firearms or weapons. Fireworks or similarly explosive and/or flammable objects, smoke or fog machines. Horns, whistles, megaphones or artificial noise makers. Recreational devices such as drones, remote-control toys, skateboards, scooters, inline skates or shoes with built-in wheels. Bicycles must be stored and locked in designated area.
  9. Feeding, petting, touching, harassing or harming wildlife, including birds, is prohibited.

 

General

  1. PADONIA has the right to do health screenings while visiting the Club including but not limited to temperature checks. Everyone coming on the property must check their temperature prior to arrival. Body temperature may not be over 100.4 degrees. Members and guests must acknowledge and consent to temperature checks that may be done at the discretion of PADONIA.
  2. Face Coverings: Based on guidance from health authorities, face coverings are required for everyone ages 2 and over. Please bring your own face covering and wear it at all times, except when swimming, during approved physically distanced sporting activities or dining. Masks are required while lounging or walking on all decks. You may remove your face covering while actively eating or drinking, but you must be seated and maintain appropriate physical distancing. Please keep at least 12 feet away from anyone not wearing a mask. Please ask for guidance.
  3. a. All face coverings (whether disposable or reusable) must:

 

  1. Be made with at least 2 layers of breathable material
  2. Fully cover the nose and mouth and secure under the chin

iii. Fit snugly but comfortably against the side of the face

  1. Be secured with ties or ear loops and allow the person to remain hands-free
  2. Neck gaiters, open-chin triangle bandanas and face coverings containing valves, mesh material or holes of any kind are not acceptable face coverings.
  3. The use of face coverings is not a substitute for physical distancing.
  4. You must provide your own disposable or reusable face covering. All of your masks and face coverings must be taken with you each day when you leave the PADONIA property, even if the mask is a disposable mask.
  5. Those at high risk of COVID-19 or any other contagious illness need to take additional precautions. Any high-risk person is responsible for their own additional precautions.
  6. Those displaying symptoms of COVID-19 or any other contagious illness will not be permitted to enter the property. Anyone who has been around someone exhibiting any symptoms of COVID-19, may have been exposed or has been asked to self-quarantine in the past 14 days, may not enter the PADONIA property. Please follow CDC guidelines for COVID-19 and all other contagious illnesses.
  7. Use proper hygiene including covering your mouth when coughing or sneezing, regular handwashing and showering before entering the pool
  8. Lounge chairs must be covered with your own, clean towel before being used
  9. We have taken enhanced health and safety measures. You and your guests must follow all regulations and instructions while visiting PADONIA. An inherent risk of exposure to COVID-19 or other contagious illnesses exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and those with underlying medical conditions are especially vulnerable. Despite the precautions PADONIA undertakes for the protection of its members, guests, customers, staff, and the community, there is no guaranty that PADONIA can prevent the transmission of the virus. In order to protect the health and safety of the entire PADONIA community, anyone failing to follow these critical requirements will be instructed to leave PADONIA property and their membership will be terminated immediately, with no refund. By visiting PADONIA you voluntarily assume all risks related to exposure to COVID-19 or other contagious illnesses. In the event that PADONIA is forced to close or limit/change offerings as a result of COVID-19 or any other contagious illnesses, no refunds or credits or other forms of compensation will be provided.
  10. Vehicles must be parked only in areas designated for parking. Handicap parking requires a visible & valid permit. Vehicles parked in violation of this rule will be towed at the owner’s expense.
  11. Theft, vandalism or other willful destruction of property will result in prosecution.
  12. Profanity or engaging in unsafe, illegal, disruptive, discourteous, uncivil or offensive behavior, including public intoxication, verbal or physically abusive behavior and/or nudity, are strictly prohibited. Violation of this provision may result in immediate termination of membership, and/or refusal of membership in the future.
  13. All persons, bags, parcels & other items are subject to screening/security checks. We reserve the right to restrict any item from being brought onto the property & handle unattended items as deemed appropriate.
  14. Bags, coolers or backpacks, with or without wheels, larger than 24” long x 15” wide x 18” high are not allowed on property.
  15. Reserving or moving furniture is not permitted.
  16. Fishing rods & equipment are only permitted at designated area of the lake or personal vehicles.
  17. No throwing objects into the lake. No barbed hooks. No fishing within 35 feet of Gazebo DANGER: Snakes, snapping turtles and other wildlife in area.
  18. Pursuant to Maryland state and local laws, no possession or use of alcoholic beverages by minors will be tolerated. The possession and/or use of illegal drugs by anyone at any time is strictly prohibited.
  19. Alcoholic beverages may not be brought onto or removed from the Padonia property.
  20. Padonia reserves the right to refuse service of alcohol to any person at any time.
  21. Commercially prepared food, outside caterers, restaurants, carry out and/or food deliveries are not permitted. Unauthorized solicitations of any kind, whether commercial, religious, educational or otherwise, or conducting any unauthorized commercial activities, including solicitations of money or other contributions or donations is prohibited.
  22. Personal beverage containers must be empty upon entry. Retail drinks must be sealed and unopened.
  23. Smoking of tobacco, cigars, pipes, e-cigarettes, or other products that produce a vapor or smoke are only permitted in designated area.
  24. All children under two (2) years of age or who are not yet toilet-trained must wear specially designed & approved swimming diapers & plastic waterproof pants when entering Baby, Children’s, Splash Pad or Main Pool. Children who are not yet toilet trained may not use the Olympia Pool or Barrett Pool.
  25. Use of the Splash Pad is reserved for children ages 6 & younger.
  26. Children who require flotation devices require a parent or Authorized Adult present on the deck and within three (3) feet at all times.
  27. Wooded areas require approved authorized use through management. Members must remain in Main Pool & Club Terrace area after dusk. All areas including sport fields and courts require adult supervision.
  28. In general, pools will be closed when the temperature is below 70 degrees Fahrenheit.
  29. If there is thunder or lightening at or after 7:00pm, the Club will close for the evening.
  30. We reserve the right to deny admission, or to require a person already admitted to leave Padonia without refund, liability or compensation for any reason.
  31. Padonia and the member and/or guest hereby agree that in the event of any disputes arising directly or indirectly from the terms of this contract, and/or out of the transaction between Padonia and the member and/or guest before, during, or after the membership term described herein, the amount of which equals or exceeds the sum of Five Thousand Dollars ($5,000.00),the parties shall first negotiate a resolution in good faith for a period of not less than 30 days before either side can commence any proceeding against the other party. At Padonia’s sole option, the matter may either (a) be litigated in the Circuit Court for Baltimore County (or the District Court for Baltimore County if the amount in dispute is less than $30,000), or (b) be submitted to binding arbitration. In the event Padonia elects to submit any dispute to arbitration, the parties will select an arbitrator, mutually agreeable to each party. In the event the parties cannot agree upon an arbitrator, an arbitrator will be assigned by an attorney-at-law whose principal office is located in Baltimore County, Maryland chosen at random, who has no present or past affiliation with either of the parties, and whose services will be paid equally by the parties. The rules of any arbitration shall be consistent with those rules established by the American Arbitration Association.
  32. Parents and Legal Guardians are responsible for supervising their children under the age of 18 at all times. Children under 17 years of age must be accompanied by a responsible and authorized adult at all time while on Padonia property. For Padonia’s purposes, an authorized adult is a parent, guardian, grandparent, nanny, babysitter or au pair age 18+ (“Authorized Adult”). Authorized Adults must have a valid driver’s license, and a vehicle on the Padonia property.
  33. Members and their guests agree to be responsible for the cost of all expenses including medical expenses incurred for injuries sustained and other health emergencies while using the facilities of Padonia. Members assume sole responsibility for any first aid treatment sought and received from Padonia and/or emergency personnel including, but not limited to, allergic reaction to first aid remedies rendered. Members shall be solely responsible for bringing all necessary and properly prescribed medicine and treatments with them that may be required while on Padonia premises.
  34. Members and guests shall be responsible for all personal items at all times. Padonia shall not be responsible for lost, stolen or damaged personal items.
  35. Members & guests agree to permit use of photographs or video taken on Padonia property by Padonia staff or their agents for promotional use.
  36. Rules & Regulations are subject to change at any time without notice.

 

Terms of Use

By using the Padonia Site, Application or Services, you agree to comply with and be legally bound by the terms and conditions of these Terms of Use (“Terms“), whether or not you become a registered user of the Padonia Services as a Member of Padonia or a visitor to the site. These Terms govern your access to and use of the Site.

In addition, certain areas of the Site (and your access to or use of certain aspects of the Services or Collective Content) may have different terms and conditions, standards, guidelines, or policies posted or may require you to agree with and accept additional terms and conditions. If there is a conflict between these Terms and terms and conditions posted for a specific area of the Site, Application, Services, or Collective Content, the latter terms and conditions will take precedence with respect to your use of or access to that area of the Site, Application, Services, or Collective Content.

If you do not agree to these Terms, you have no right to obtain information from or otherwise continue using the Site, Application, or Services. Failure to use the Site, Application, or Services in accordance with these Terms may subject you to civil and criminal penalties.

IF YOU CHOOSE TO CREATE A PROFILE ON THE PADONIA SITE, YOU UNDERSTAND AND AGREE THAT YOUR RELATIONSHIP WITH PADONIA IS LIMITED TO BEING A MEMBER AND/OR AN INDEPENDENT, THIRD-PARTY CONTRACTOR, AND NOT AN EMPLOYEE, AGENT, JOINT VENTURER OR PARTNER OF PADONIA FOR ANY REASON, AND YOU ACT EXCLUSIVELY ON YOUR OWN BEHALF AND FOR YOUR OWN BENEFIT, AND NOT ON BEHALF OF OR FOR THE BENEFIT OF PADONIA. PADONIA DOES NOT CONTROL, AND HAS NO RIGHT TO CONTROL, YOUR INFORMATION, YOUR OFFLINE ACTIVITIES, OR ANY OTHER MATTERS THAT YOU PROVIDE. AS A MEMBER YOU AGREE NOT TO DO ANYTHING TO CREATE A FALSE IMPRESSION THAT YOU ARE ENDORSED BY, PARTNERING WITH, OR ACTING ON BEHALF OF OR FOR THE BENEFIT OF PADONIA, INCLUDING BY INAPPROPRIATELY USING ANY PADONIA INTELLECTUAL PROPERTY.

YOU ACKNOWLEDGE AND AGREE THAT, BY ACCESSING OR USING THE SITE, APPLICATION, OR SERVICES OR BY DOWNLOADING OR POSTING ANY CONTENT FROM OR ON THE SITE, VIA THE APPLICATION OR THROUGH THE SERVICES, YOU ARE INDICATING THAT YOU HAVE READ, AND THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS AND RECEIVE OUR SERVICES (INCLUDING WHETHER OR NOT YOU HAVE REGISTERED WITH THE SITE AND APPLICATION. IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SITE, APPLICATION, SERVICES, OR COLLECTIVE CONTENT.

If you accept or agree to these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms and, in such event, “you” and “your” will refer and apply to that company or other legal entity.

We do not warrant complete accuracy.  Certain events beyond our control may affect the timing and availability of information available on our site. Our information is intended to be as current as accurate as possible and we use best efforts to ensure that our content is as accurate and meaningful as possible. However, we do not warrant that our services are entirely accurate, complete, reliable, current, or error-free. Governing Law

By visiting Padonia’s website, you agree that the laws of the state of Maryland, without regard to principles of conflict of laws, will govern these Terms of Use and in the event that any dispute of any sort that arises between you and Padonia.

Intellectual Property Rights and Ownership

The copyright in all material provided on this site, such as text, graphics, logos, layout, formatting, links, appearances, button icons, images, audio clips, digital downloads, data compilations, is the proprietary property of Padonia, and is protected by United States and international copyright laws. In addition, the processes used by Padonia to develop and publish its content is based on proprietary know-how that is protected by United States and international copyright laws. All rights are reserved.

All content on this site is the exclusive property of Padonia and protected by U.S. and international copyright law. None of the material on this website may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, without the express written permission of Padonia or the copyright owner.

Limitation of Liability

As a provider of informational services only, Padonia makes no express or implied warranties of any kind whatsoever.

Padonia will specifically not be liable, under any legal definition, for incidental, consequential, punitive or similar damages resulting from the use of this site. In no event, even if we have been advised of or are aware of the potential for a claim from a third party(ies), will Padonia be liable for any loss of profits, loss of use, or any other loss, incidental or otherwise, related to the performance of, use of or in connection with any use of this site or the information appearing on it. User Conduct

You understand and agree that you are solely responsible for compliance with any and all laws, rules, regulations, and Tax obligations that may apply to your use of the Site, Application, and/or Services. In connection with your use of the Site, Application, and Services, you may not and you agree that you will not:

• violate any local, state, provincial, national, or other law or regulation, or any order of a court, including, without limitation, zoning restrictions and Tax regulations;
• use manual or automated software, devices, scripts, robots, backdoors or other means or processes to access, “scrape,” “crawl” or “spider” any web pages or other services contained in the Site, Application, Services or Collective Content;
• access or use our Site, Application, Services or the Padonia  Application Programming Interface (API) to use, expose, or allow to be used or exposed, any Padonia Content: (i) that is not publicly displayed by Padonia in its search results pages or listing pages; (ii) in any way that is inconsistent with the Padonia Privacy Policy or Terms of Service; or (iii) in any way that otherwise violates the privacy rights or any other rights of Padonia’s users or any other third party;
• use the Site, Application, or Services for any commercial or other purposes that are not expressly permitted by these Terms or in a manner that falsely implies Padonia’s endorsement, partnership or otherwise misleads others as to your affiliation with Padonia;
• dilute, tarnish or otherwise harm the Padonia brand in any way,
including through unauthorized use of Collective Content, registering and/or using Padonia or derivative terms in domain names, trade names, trademarks or other source identifiers, or registering and/or using domains names, trade names, trademarks or other source identifiers that closely imitate or are confusingly similar to Padonia domains, trademarks, taglines, promotional campaigns or Collective Content
• copy, store or otherwise access or use any information contained on the Site, Application, Services, or Collective Content for purposes not expressly permitted by these Terms;
• infringe the rights of Padonia or the rights of any other person or entity, including without limitation, their intellectual property, privacy, publicity or contractual right
• interfere with or damage the Site, Application or Services, including, without limitation, through the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, backdoors, packet or IP spoofing, forged routing or electronic mail address information or similar methods or technology;

• use our Site, Application or Services to transmit, distribute, post or submit any information concerning any other person or entity, including without limitation, photographs of others without their permission, personal contact information or credit, debit, calling card or account numbers;
• use our Site, Application, Services or Collective Content in connection with the distribution of unsolicited commercial email (“spam”) or advertisements unrelated to lodging in a private residence;
• “stalk” or harass any other user of our Site, Application, Services or Collective Content, or collect or store any personally identifiable information about any other user other than for purposes of transacting as a Member of Padonia or an authorized guest;
• register for more than one Padonia Account or register for a Padonia Account on behalf of an individual other than yourself;
• impersonate any person or entity, or falsify or otherwise misrepresent yourself or your affiliation with any person or entity;
• use automated scripts to collect information from or otherwise interact with the Site, Application, Services or Collective Content;
• as a Member, submit any false or misleading information;
• engage in disruptive, circumventive, abusive or harassing behavior in any area or aspect of our Site, Application, or Services;
• post, upload, publish, submit or transmit any Content that: (i) infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading (directly or by omission or failure to update information) or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any other person; or (vii) promotes illegal or harmful activities or substances;
• systematically retrieve data or other content from our Site, Application or Services to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory or the like, whether by manual methods, through the use of bots, crawlers, or spiders, or otherwise;
• use, display, mirror or frame the Site, Application, Services or Collective Content, or any individual element within the Site, Application, Services or Collective Content, Padonia’s name, any Padonia trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page in the Site, Application or Services, without Padonia’s express written consent;
• access, tamper with, or use non-public areas of the Site, Application or Services, Padonia’s computer systems, or the technical delivery systems of Padonia’s providers;
• attempt to probe, scan, or test the vulnerability of any Padonia system or network or breach any security or authentication measures;
• avoid, bypass, remove, deactivate, impair, descramble, or otherwise circumvent any technological measure implemented by Padonia or any of Padonia’s providers or any other third party (including another user) to protect the Site, Services, Application or Collective Content;
• forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Site, Services, Application or Collective Content to send altered, deceptive or false source-identifying information;
• attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Site, Services, Application or Collective Content;
• advocate, encourage, or assist any third party in doing any of the foregoing; or
• make or accept a payment outside Padonia’s system. If you do so, you acknowledge and agree that you: (i) would be in breach of these Terms; (ii) accept all risks and responsibility for such payment, and (iii) hold Padonia harmless from any liability for such payment.

Padonia has the right to investigate and prosecute violations of any of the above to the fullest extent of the law. In addition, and as set in these Terms, Padonia may take a range of actions against you, including but not limited to removing or disabling access to any or all of your Member Content or deactivating or canceling your Padonia Account, and/or terminating your Padonia membership entirely for a violation of this Section or these Terms.

Padonia may access, preserve and disclose any of your information if we are required to do so by law, or if we believe in good faith that it is reasonably necessary to (i) respond to claims asserted against Padonia or to comply with legal process (for example, subpoenas or warrants), (ii) enforce or administer our agreements with users, (iii) for fraud prevention, risk assessment, investigation, customer support, product development and de-bugging purposes, or (iv) protect the rights, property or safety of Padonia, its users, or members of the public. You acknowledge that Padonia has no obligation to monitor your access to or use of the Site, Application, Services or Collective Content or to review, remove, disable access to or edit any Member Content, but has the right to do so for the purpose of operating and improving the Site, Application and Services (including without limitation for fraud prevention, risk assessment, investigation and customer support purposes), to ensure your compliance with these Terms, to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body, to respond to content that it determines is otherwise objectionable or as set forth in these Terms. Information That Is Routinely Collected By Our Site Technology

We run appropriate scans and test all of our services configuration settings to ensure they are working properly. We also apply security releases/patches and other updates as they are released.
